Privacy Policy

Ember Stone Properties ("Ember Stone," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit emberstoneproperties.com or contact us, how we use that information, and the choices you have. Ember Stone Properties operates from Indianapolis, Indiana. Brokerage services are provided through Triple E Realty.

Quick summary: We collect the information you give us when you submit a property inquiry (address, name, phone, email) so we can respond with a written offer or MLS estimate. We use Google Analytics to understand site traffic. We do not sell your information. We do not share your information with third parties for marketing.

1. Information We Collect

1.1 Information you provide directly

When you submit a lead form, request an offer, or call us, you may provide:

  • Property address
  • Your name
  • Phone number
  • Email address
  • Information about your situation (probate, foreclosure, divorce, relocation, condition of the property, timing preferences, financial considerations)
  • Any other details you choose to share during a conversation or in writing

1.2 Information collected automatically

When you visit the site, we automatically collect limited technical information through standard web logs and analytics tools:

  • IP address (used for spam protection and aggregated geographic analysis)
  • Browser type and version
  • Device type (desktop, mobile, tablet)
  • Pages visited on emberstoneproperties.com, time spent, scroll depth, and outbound clicks
  • Referring URL (the website you came from, if any)
  • Approximate location based on IP (city-level only, not precise GPS)

We do not collect precise device location, biometric information, or use device fingerprinting.

1.3 Cookies and similar technologies

We use a small number of cookies:

  • Google Analytics 4 (G-9HZ41CZT8L) — sets cookies (_ga, _ga_*) to measure aggregate site usage. These cookies expire after up to 2 years.
  • Functional cookies / localStorage — we use localStorage to remember whether you've already seen our exit-intent dialog (so we don't show it again for 7 days). This is set only in your browser and is never transmitted to us.

You can disable cookies in your browser settings. If you do, the site will still work, but exit-intent suppression and analytics will not function correctly.

2. How We Use Your Information

We use the information you provide and the limited technical information we collect for the following purposes:

  • To respond to your inquiry. When you submit a form or call us, we contact you about your property — typically within 24 hours — to discuss options, provide a written cash offer, or share an MLS estimate.
  • To prepare and present offers. If we make a cash offer or list your property through Triple E Realty, we use your information to draft contracts, coordinate with title companies, and complete required paperwork.
  • To follow up. If you don't respond to our initial contact, we may follow up by phone, email, or text for a reasonable period. You can opt out at any time by replying STOP or telling us to remove you from follow-up.
  • To improve the site. Aggregate analytics data helps us understand which pages are useful and which need work.
  • To comply with the law. We may use or disclose information when required by law, court order, or to enforce our terms.
  • For brokerage compliance. Where Ember Stone or Brenden Stadelman acts in a real estate brokerage capacity through Triple E Realty, Indiana real estate license law (876 IAC) and federal Fair Housing law may require us to retain certain records.

3. How We Share Your Information

We do not sell your personal information. We do not rent, trade, or release your information to third parties for their marketing purposes. We share information only in these specific cases:

  • With title companies and attorneys when closing a transaction you've agreed to.
  • With Triple E Realty for MLS listings or where brokerage services are involved.
  • With service providers who help us operate the business: Supabase (data storage), Google Workspace (email), Google Apps Script (email forwarding), and Vercel (website hosting). These providers process information only on our instructions and are bound by their own privacy and security obligations.
  • When required by law, in response to a valid subpoena, court order, or other legal process; or to protect the rights, safety, or property of Ember Stone, Triple E Realty, or any person.
  • In a business transfer, if Ember Stone is acquired or merges with another entity, information may transfer as part of that transaction. We would notify you before this happens.

4. Communications & Opt-Out

If you submit a form or call us, you consent to receive a response by phone, text, or email about your inquiry. By providing a phone number, you agree we may contact you at that number, including by text message, regarding your property. Standard message and data rates may apply.

You can opt out at any time:

  • Reply STOP to any text message from us.
  • Email brenden@emberstonere.com with the subject "Remove me."
  • Call (317) 731-2619 and ask to be removed.

We comply with the federal Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. We do not place calls to numbers on the National Do Not Call Registry without a prior business relationship or your express consent.

5. Data Retention

We retain lead and contact information for as long as needed to respond to your inquiry, complete any transaction, and meet our legal and brokerage record-keeping obligations. In general:

  • Inquiries that do not result in a transaction are typically retained for 3 years for follow-up and brokerage compliance.
  • Transaction records (cash purchases, MLS listings) are retained for at least 5 years per Indiana brokerage record-keeping requirements.
  • Analytics data is retained per Google Analytics defaults (up to 14 months for event-level data).

You can request earlier deletion by contacting us (see Section 8).

6. Data Security

We use commercially reasonable safeguards to protect your information, including HTTPS encryption on the website, row-level security on our database, anti-spam protections (honeypot field and submission time-gate), and limited internal access. No system is perfectly secure; if you have reason to believe your information has been compromised, please contact us immediately at (317) 731-2619.

7. Children's Privacy

The site is not directed to children under 13 and we do not knowingly collect personal information from anyone under 13. If we learn we have collected information from a child under 13, we will delete it. If you believe a child has submitted information to us, please contact us so we can remove it.

8. Your Rights

Indiana does not currently have a comprehensive consumer privacy statute equivalent to the California Consumer Privacy Act (CCPA) or the European GDPR, but we honor reasonable requests from anyone:

  • Access — ask what information we have about you.
  • Correction — ask us to correct inaccurate information.
  • Deletion — ask us to delete your information (subject to brokerage record-keeping requirements).
  • Opt-out of follow-up — see Section 4.

If you live in California, the EU, or another jurisdiction with stronger privacy laws, we will honor your additional rights under those laws to the extent they apply.

9. Third-Party Links

The site may link to third-party websites such as our Google Business Profile review page or external resources. We are not responsible for the privacy practices of those sites. Read their policies before submitting information.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top will change when we do. Material changes will be highlighted on the homepage or by direct notice when reasonably practical.
