Terms of Service
These Terms of Service ("Terms") govern your use of emberstoneproperties.com (the "Site") operated by Ember Stone Properties ("Ember Stone," "we," "us," or "our"). By using the Site, submitting a form, or contacting us, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Ember Stone Properties
Ember Stone Properties is a Central Indiana real estate investment company. The Site is operated by Brenden Stadelman, a Marine Corps veteran and a licensed Indiana real estate broker. Brokerage services — including any MLS listing, agency representation, or real estate licensee activity — are provided through Triple E Realty in compliance with 876 IAC 8-1-8 (Indiana Real Estate Commission rules) and applicable Indiana real estate license law.
Ember Stone Properties (the investor brand) and Triple E Realty (the brokerage) are distinct. Communications about a direct cash purchase are with Ember Stone as principal. Communications about an MLS listing or agency representation are through Triple E Realty.
2. What the Site Provides
The Site provides:
- Information about selling a home in Indianapolis and Central Indiana
- Education about Indiana probate, foreclosure, divorce-related real estate situations, and selling as-is
- A way to request a written cash offer or an estimated MLS sale price
- Contact methods for Brenden Stadelman / Ember Stone Properties
Use of the Site does not create any agency, fiduciary, brokerage, or attorney-client relationship between you and Ember Stone Properties, Brenden Stadelman, or Triple E Realty. A brokerage relationship begins only when a written brokerage agreement is signed in compliance with Indiana law.
3. No Legal, Tax, or Financial Advice
Content on the Site about Indiana probate (including the Small Estate Affidavit, IC 29-1-8-1, transfer-on-death deeds, intestate succession, personal representative duties), foreclosure (judicial process, sheriff's sale, redemption), divorce property division, and similar topics is provided for general educational purposes only.
Nothing on this Site is legal advice, tax advice, accounting advice, or financial advice. Real estate law, probate, and family law vary by situation and change over time. You should always consult:
- A licensed Indiana attorney for legal advice
- A CPA or tax advisor for tax implications of a sale
- A licensed real estate broker (we can refer or assist through Triple E Realty) for brokerage advice on listing your home
4. No Offer Until in Writing
Any number, range, estimate, or comment shared in conversation, by email, text, or on the Site is preliminary and informational. No real estate offer is binding until it is in a written purchase agreement signed by both parties. Estimates of MLS sale price are not appraisals and should not be relied on as such.
We don't guarantee:
- That you will receive an offer
- The amount of any offer or estimate
- That a transaction will close, or close on a specific date
- Sale price on an MLS listing
- Tax outcomes, lien clearance, mortgage payoff results, or any specific financial result
Every property and situation is evaluated individually based on the property condition, market conditions, title, and other factors.
5. Fair Housing
Ember Stone Properties and Triple E Realty comply with the federal Fair Housing Act, the Indiana Civil Rights Law, and all related laws prohibiting discrimination in housing. We do not discriminate based on race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, disability, ancestry, or any other characteristic protected under federal, state, or local law.
If you believe you have experienced housing discrimination, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD) or the Indiana Civil Rights Commission.
6. TCPA & Communication Consent
By submitting a form or providing your phone number, you agree we may contact you at that number — including by call, text, or pre-recorded message — regarding your inquiry. Standard message and data rates may apply. Your consent is not a condition of any purchase. You can opt out at any time by replying STOP to texts, telling us to remove you, or emailing brenden@emberstonere.com.
7. Acceptable Use
You agree not to:
- Submit false or misleading information through the Site (including using the lead form to submit other people's properties without their knowledge)
- Use the Site for any unlawful purpose
- Attempt to access, scrape, or interfere with the Site's underlying systems beyond normal browsing
- Use automated tools to fill the form or otherwise overwhelm the contact system
- Use the Site to harass us or others
We use anti-spam protections including a honeypot field and submission time-gate. Repeated abuse may result in your IP address being blocked.
8. Intellectual Property
All content on the Site — text, graphics, logos, photos, schema markup, and the layout of pages — is owned by Ember Stone Properties or its licensors, except where third-party content is attributed (for example, photos credited to specific photographers, or schemes that reference Indiana statutes). You may view and share Site content for personal, non-commercial purposes, but you may not reproduce, republish, or use Site content for competing commercial purposes without our written permission.
"Ember Stone Properties" and the Ember Stone logo are common-law trademarks of Ember Stone Properties. "Triple E Realty" is referenced with permission and is the trademark of its owner.
9. Third-Party Services & Links
The Site uses or links to third-party services including Google (Analytics, Maps, Fonts, Business Profile review URL), Supabase (data storage), Apps Script (email forwarding), and Vercel (hosting). The Site also links to external pages (blog content, attorney resources, Indiana state resources). We are not responsible for the content, accuracy, or privacy practices of any third party.
10. Disclaimer of Warranties
The Site and the information it contains are provided "as is" and "as available." To the maximum extent allowed by law, Ember Stone Properties disclaims all warranties of any kind — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability.
We do not guarantee that the Site will always be available, that information will be accurate, that the lead form will always submit successfully, or that responses will be sent within any specific timeframe. If urgent (for example, a sheriff's sale is imminent), call us at (317) 731-2619.
11. Limitation of Liability
To the maximum extent allowed by Indiana law, Ember Stone Properties, Brenden Stadelman, and Triple E Realty are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or your communications with us, including lost profits, lost data, lost opportunity, or business interruption. Our total aggregate liability for any claim arising from the Site is limited to $100.
This limitation does not apply where prohibited by law (for example, to claims of gross negligence, willful misconduct, fraud, or violation of Fair Housing law).
12. Indemnification
You agree to indemnify and hold harmless Ember Stone Properties, Brenden Stadelman, and Triple E Realty from any claim arising from your misuse of the Site, your violation of these Terms, or your submission of false information through the lead form.
13. Governing Law & Venue
These Terms and any dispute arising from the Site are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any lawsuit must be filed in a state or federal court located in Marion County, Indiana, and you consent to jurisdiction there.
Disputes specifically about an Indiana real estate transaction may also be subject to Indiana Real Estate Commission rules (876 IAC) and the dispute resolution procedures of Triple E Realty or any applicable real estate board.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Site after an update means you accept the new Terms. Material changes will be highlighted on the homepage or by direct notice when reasonably practical.
15. Severability
If any provision of these Terms is found invalid or unenforceable, the rest remains in effect.
